Persuasive Essay Euthanasia - 1446 Words

Euthanasia: A Legal Murder According the Merriam-Webster dictionary, Euthanasia is â€Å"the act or practice of killing or permitting the death of hopelessly sick or injured individuals (such as persons or domestic animals) in a relatively painless way for reasons of mercy. This procedure seems appealing to the many people around the world who suffer from terminal illnesses. In the minds of these people euthanasia or doctor-assisted suicide seems like the only escape. As stated in a journal, â€Å"My friend now believes that the only humane act would be to end her mother’s suffering. ‘Whats she is going through is cruel,’ she said. ‘She has no life.’† (Wheatley). This shows how sometimes people think that ending their life would be the only way†¦show more content†¦People who have a condition that clouds their judgment could be affected by this. Arthur Caplan uses this example from Kevorkians work to illustrate this, â€Å"Janet Adkins decided to kill hersel f when she learned that she has Alzheimers disease. Let’s assume the diagnosis was correct. Would the fact that she had Alzheimers complicate the assessment of her competence to decide to kill herself† (Caplan 36). Ms. Adkins was not in the right state of mind when she asked Dr. Kevorkian to help assist her in suicide. Another example of a different patient this happened to was a woman who was diagnosed with MS (multiple sclerosis). This story is about Rebecca Badger who was diagnosed with MS and decided killed herself. Later an autopsy showed that the diagnosis was wrong and that a second opinion would have saved her life ( â€Å"Impact of Euthanasia on the Family†). This is yet another example of how euthanasia could end a perfectly healthy persons life. Also when patients receive this diagnoses it makes them feel as if they have no other choice but to kill themselves. Yet doctors do nothing to check or convince them that euthanasia is not the right decision. This proves the real danger of euthanasia, especially in the hands of doctors who do not understand their patients frame of mind. Personal statement My interest in Global Media and Communications programme offered by London School of Economics lies primarily in the opportunity to experience more than a single education environment and, thus, to receive different perspectives on the field, which I find essential in the Global Media expertise. Answer: Relationships Between Budget Targets and Performance Evaluation Procedures of HCC Industries Under any normal circumstance, no profits making organization would want to have a disparity between their budget targets and their performance evaluation procedures. These should always go hand in hand if the purpose of the business, that is generating profits for the owners and having a general positive performance (Sitkin, Cardinal and Bijlsma-Frankema, 2010).HCC is a profit making organization that has been operating in a largely competitive industry, requiring adoption and use of best practices for survival purposes. An organization is defined by its ability or inability to meet its set targets. If there is a positive trend where targets are being met, the organization is said to be performing well while if there is a negative trend where targets are not being met, it is said to be performing poorly (Collier and Agyei-Ampomah, 2006). In HCC there was setting of budget targets for each division, these were in the form of quarterly and monthly budget targets which were supposed to be met failure to which the division manager concerned would have a hard task of explaining why they were not met. These budget targets were the force what guided the performance of various stakeholders .The company used meeting of these targets as an evaluation tool. A division was evaluated on its ability to generate profits and meet or exceed its targets or inability to meet these targets in the long run. Essentially, this evaluation was not based on how low or high these profits were .Rather it was based on the relationship between the profits for each division and its initial targets. Each division had its targets which were defined by its previous performance record. Apart from evaluation based on profits, the company also used other techniques to evaluate its performance. Evaluations such as bookings for each division, shipments, returns, efficiency, shipments, rework aging and delinquencies were also used .These standards of performance was negotiated upon by the management and managers were tasked with the responsibility of ensuring that they monitored the whole process so that everything went on as expected. Reasons for Abandoning of Stretch Budgeting Concept by HCC Corporate Managers Budgeting is the process of planning for future income and expenditure that is used as a guide for spending and saving budgeting is an important component in every business (Thygesen, 2012).Business that operate with budgets have the ability of monitoring their operations hence performance unlike those that operate without budgets. However there are different budget types that that can be used .Among them is a stretch type of budget. A stretch budget involves setting of sales and marketing forecasts that are higher than the possible estimates .The corporate managers believed that by setting aggressive targets, the division managers would be motivated to work with more zeal towards realization of organizational goals. However, they had to abandon it for a number of reasons. The technique makes people to always think optimistically. Optimism is an important component in any endeavor but the level and nature of optimism is what brings the difference. The level of optimism that is emphasized by stretch technique is quite high (Pickett, 2001) This technique is therefore good for large organizations that and which are in apposition of understanding their markets well as well as influence them. However this was not the case with HCC industries. One factors that made it inappropriate for them was the fact that they did not understand their markets well which was a requirement for those organizations that aimed at benefiting from the stretch budgeting method. Additionally it was designed by a large consulting firm that did not quite well understand the working of smaller companies. It was suitable for organizations that had already established themselves and HCC Industries was not yet there so this was just the wrong budgeting method for the company because no matter what effort was put it would not work very well. The old process was undesirable because it allowed laxity among Divisional manager and their staff. One component of the old technique was the fact that it was characterized by high levels of optimism. It involved setting of unrealistic targets so that performance would be a notch higher .this was very well known to the Divisional managers and their staff as well. This was a basis for underperformance because it made it okay to perform poorly because after all the targets set by the corporate were too optimistic and unachievable Another factor that led to the abandonment of this plan was the fact that for quite some time the corporate had been missing its plans .There was therefore the need of having in place a concept that would make it possible for the corporate to achieve its plans with ease. The company had also been recording a negative performance trend for quite some time. A change of concept was therefore necessary for doing away with this negative with this negative trend. Usually, any there is no business that aims at making losses. It is the desire of every other organization to make as much profit as possible. Continued negative performance might have had significant impact on the image of the company so a change was necessary. The change was also necessitated by lack of uniformity in performance across the various departments .For a number of years the company was used to the fact that there were those divisions that would always perform well and those that would always perform poorly. This lack of uniformity makes it hard for the corporate to make plans touching on the whole Company because the strengths and the abilities of different department s were the same. It was therefore necessary to have in place methods that would place the various divisions at the same level so that the company would move forward as a whole instead of having some divisions lag behind others in as far as achievement of budget targets was concerned. The New Processes and Strengths and Weaknesses The new philosophy laid its emphasis on the possible minimum performance standards. It would require people to hit minimum performance standards then their performance would be rated based on their ability to hit these targets. The earning of bonuses and other extra rewards will therefore be based on the ability to meet minimum standards .The new process will also require managers to submit budgets that are realistic and achievable. A pool bonus would be instituted and offered if a department was able to achieve all its targets such as profits and delinquencies. However, the importance of set targets would differ from time to time. Advantages There are a number of advantages that would result from the new philosophy. First and most important is the fact that it would enhance the general performance of the organization. Having in place realistic goals and achievable targets has the possibility of motivating people towards the achievement of organizational goals .Unlike the old system that involved unrealistic targets which to some extend allowed people to choose to perform or fail to perform, with the new philosophy there was no two way about it as everything was tied on performance and meeting of set targets. The process allowed for budget negotiation process. This means that the corporate and division managers could meet sit together and agree on budgets for each division. These agreed upon budgets would then be used as the basis of evaluation depending on the extent to which they have been achieved or not achieved. The new philosophy allowed thorough monitoring of performance. Division managers were tasked with the responsibility of ensuring that their particular departments met the agreed upon targets .so they had to closely monitor the performance of their staff members to ensure that these requirements were met. On the other hand corporate managers were required to monitor the activities of individual departments to ensure that they were working towards the achievements of their targets. The other advantage of this new philosophy was the centralization of research, advertising and promotion. Previously departments worked independently without any form of interrelationships with the adoption of the new philosophy, a corporate marketing function was established to assist in research, marketing and promotion. This was to cater for such needs for the whole organization .this was advantageous is in that it was possible to balance the performances of different departments so that performance related disparities were minimized Additionally a corporate engineering service function was started with the aim of coming up with new product designs usable by the connector divisions .This was likely to improve the prospect of the Organization. Disadvantages Although there were numerous advantages associated with the new philosophy, there were disadvantages as well. One is that the initial independence of individual divisions would be lost with the new philosophy because it allowed the corporate to dictate terms to individual divisions although this was negotiated upon. This also disadvantaged the divisional managers in that their bonuses would not be automatic as they were before but they had to be worked for. Evaluation of the decision to use minimum performance standard (MPS) targets instead of stretch targets The decision to abandon the old method of stretch targets to the new method of Minimum performance standard was quite informed and appropriate for the company. Based on the fact that the company had not been doing quite well before, there was a need of changing their tactic so that they could improve their chances of competing favorably against other competitions in the market. Minimum performance standards would give the company a real chance of having a control over their performance across various departments .This was a positive move given the disparities that had been there in as far as performance of different divisions was concerned. I think this was in order for the purposes of having all departments work on the same footing. Its also important that any organization that aims at motivating its employees towards achievement of certain goals focuses on how realistic their achievement is. If they are realistic, the employees will be motivated to achieve them but if they are not, they will be demoralizing. The old philosophy can be said to have had negative impact on the performance of the organization, besides setting targets that were unrealistic, it was not motivating enough for the achievement of the same and encouraged employees not to exploit their full potential .However with the new system, it allowed performance based incentives .This was not only likely to encourage performance under different divisions .It was also capable of improving business prospects if it was handled appropriately. Should HCC managers have expected that the MPS target-setting philosophy would be equally effective in all four operating divisions? Based on this question, a no would have been most appropriate. Based on the performance history of the organization, there had existed disparities in as far as performance by different divisions .This meant that the individual strengths for each division was different. This being the case, it was not appropriate to imagine that just because the philosophy was considered appropriate it would bear the same results for was not a guarantee. Therefore the managers had no absolute reason of expecting that the philosophy would have been equally effective in all divisions. Additionally even with the new philosophy, the individual capabilities of division managers and their staff would have a significant role to play in the outcome .Its true that different individuals possess different capabilities and abilities .This is to mean that in a given similar task there are those who are likely to perform better than others and vice versa .This is what would have to happen in this case too. The performance of each division would depend on the ability of the manager to mobilize his staff towards achievement of set goals. It would also depend on the individual abilities of the staff members and their general commitment towards their assigned tasks and the achievement of organization goals. With this as the case therefore disparities would still be there in as far as the performance was concerned Also because this was a new philosophy that had not been tried before chances of it succeeding or failing were in equal measure so there would be no guarantee that it would be effective for all the departments in equal measure. What could have been done to Improve the Implementation Implementation of the new philosophy would have been improved by first trying it on one or two departments first before rolling it out to the whole organization, this could have given the corporate a rough picture of what to expect under the new philosophy .If there was a positive outcome they could then be able to implement it in other divisions. Sufficient consultation with the various stakeholders would also have improved implementation. There was a general feeling among the Division managers that the new philosophy was being forced on them. They even compared it to someone dictating to them when to brush their teeth. That could only mean one thing, that there were no sufficient consultations with them. Had there been a platform for this their fears and worries could have been addressed and they could be able to adopt and implement fully. The company should also have contracted experts to help in the transition because there was no previous experience in the organization on the new philosophy. On the television those types of figures become idealized even if in real life they are unsuccessful or egotistical, in other words full of narcissistic characteristics. The shows like The Simple Life, Newlyweds: Nick and Jessica or Hogan Knows Best invite the audience to enter and to understand every day life of celebrities. The aim of these shows is to display celebrities being themselves, in other words, to document how narcissistic personalities cope with every day life. The viewers become grateful and don’t even pay the attention what is really happening in the show, because the â€Å"IT† celebrity gave an opportunity and flattered the viewers by letting them into their world. The biggest problem with this type of show is that the young viewers get confused with what is normal and what is not. The episode and the question received hundreds of comments, public and media attention, not because it was an unintelligent question, but because the audience felt a connection with the protagonist. Since it received so many feedback Jessica made a public statement saying that she’s just a normal human who sometimes makes mistakes. The audience â€Å"went wild† because they felt that she’s just like them and by that time it didn’t matter that she is multimillionaire recording artist. The participants are known as narcissists, which just let the viewers to become ones as well. The people who succeed on these shows appear to have little knowledge of education or hard work. Instead, they manipulate, act out while living their known fabulous lives.  The show Dr. 90210, The Swan or I Want a Famous Face, glorify the â€Å"improvement† of the body, by any means necessary. These shows might motivate some viewers to make some positive changes in their lives but in general it glories the narcissistic view of body image. However, all of these shows have one function, to entertain. German Proficiency Tests and Certification At some point in your study of the German language, you may want to, or you might need to take a test to demonstrate your command of the language. Sometimes a person may want to take it for his or her satisfaction, while in some cases a student may be required to take a test such as the Zertifikat Deutsch (ZD), the Großes Sprachdiplom (GDS), or the TestDaF. There are more than a dozen tests you can take to certify your proficiency in German. Which test you take depends on several factors, including for what purpose or for whom you are taking the test. If you plan on attending a German university, for instance, you need to find out which test is required or recommended. While many colleges and universities have their in-house proficiency tests, what we are discussing here are established, widely recognized German tests offered by the Goethe Institute and other organizations. A standardized test such as the widely accepted Zertifikat Deutsch has proven its validity over the years and is recognized as certification in many situations. However, it is not the only such test, and some of the others are required instead of the ZD by some universities. There are also specialized German tests, particularly for business. Both the BULATS and the Zertifikat Deutsch fà ¼r den Beruf (ZDfB) test a high level of language competency for business German. They are only suitable for people who have the appropriate background and training for such a test. Test Fees All of these German tests require payment of a fee by the person being tested. Contact the test administrator to find out the cost of any test you are planning to take. Test Preparation Since these German proficiency examinations test general language ability, no one book or course prepares you for taking such a test. However, the Goethe Institute and some other language schools do offer specific preparatory courses for the DSH, GDS, KDS, TestDaF, and several other German tests. Some of the tests, particularly the business German tests, provide specific requirements (how many hours of instruction, type of courses, etc.), and we outline some of that in the following list. However, you need to contact the organization that administers the test you want to take for more detailed information. Our list includes Web links and other contact information, but one of the best sources of information is the Goethe Institute, which has local centers in many countries all over the globe, and an excellent Web site. BULATS (Business Language Testing Service) Organization: BULATSDescription: The BULATS is a worldwide business-related German proficiency test administered in cooperation with the University of Cambridge Local Examinations Syndicate. Besides German, the test is also available in English, French, and Spanish. BULATS is used by organizations to assess the language skills of employees/job applicants in a professional context. It comprises several tests that can be taken separately or in combination.Where/When: Some Goethe Institutes around the world offer the German BULATS test. DSH - Deutsche Sprachprà ¼fung fà ¼r den Hochschulzugang auslndischer Studienbewerber (German Language Test for College Admission for Foreign Students) Organization: FADAFDescription: Similar to the TestDaF; administered in Germany and by some licensed schools. In addition to spoken fluency, candidates will need advanced grammatical ability and be capable of preparing texts and discussing issues about German literature, natural sciences, and economics.Where/When: The GDS can be taken at Goethe Institutes and other testing centers in Germany and other countries. The words spoken by Martin Luther King Jr. and Malcolm X were so strong and influential, helping them gain great audiences and followers. Malcolm X, also advocated for the end to segregation, but emphasized the needs for blacks to become independent of the white man, and stand up for themselves. Both King and Malcolm X had similar goals in their minds, but took distinct paths to attain those goals. Both of their many speeches varied with great distinction. While the content and underlying ideas of the speeches may have different examples and ideas, they both use many common literary devices and rhetorical strategies to attain their audience’s attention. It is through Malcolm X’s use of emotion, together with the use of other strategies, that he ultimately created a more passionate influence on his audience. The early lives that these men lived had much influence on how they would later view racism, and speak out on segregation. Martin Luther King Jr., born Micheal Luther King Jr., was raised with a middle-class family, where his mother and father stressed the importance of obtaining an education (Martin). Malcolm X, born Malcolm Little, came from a place filled with fear and danger, where the â€Å"Klansmen shouted threats and warnings [about how] ‘the good old Christian white people’ were not going to stand for [his] father’s ‘spreading trouble’† (X, Malcolm and 1). Malcolm’s early childhood experiences would be there to haunt him for the rest of his life. The experiences that these men encountered at a young age, planted the seeds to how they would flourish into the voices of the oppressed African-American people, and the ways in which they would deliver their speeches. From a young age, Malcolm had suffered the effects of racism, never forgetting his eighth grade teacher telling him that â€Å"[he had] to be realistic about being a nigger. A lawyer- [that was] no realistic goal for a nigger† (X, Malcolm and 38). X, an intelligent student sharing similar dreams as King of becoming a lawyer, where soon shattered, causing him to drop out of school, and turn to drugs in order to get money. After being in jail for six years, Malcolm finally turned to Allah, where he began preaching black supremacy, and the separation between blacks and whites. Martin Luther King Jr.’s most prominent â€Å"I have a Dream† speech is lucid with its use of emotion, and all ­usion. King argues that African-Americans are not free according to the rights outlined in the United-States constitution. King not only presents his argument to the African-American community, but rather to all Americans, white and black. King delivers his argument successfully through his use of ethos. Throughout the speech, King alludes to his Christian morals, speaking out on how, â€Å"one day every valley shall be exalted, and every hill and mountain shall be made low, the rough places will be made plain, and the crooked places will be made straight; and the glory of the Lord shall be revealed and all flesh shall see it together† (Luther King). King acknowledges the fact that the majority of his audience believes in Christianity, therefore understanding the allusion to the bible. Finally, King refers to his audience as â€Å"his people.† This implies that King sees his audience equal and also it shows that not only the black people are â€Å"his people.† King presents his argument towards freedom, strategically placing emphasis on his moral authority. Malcolm X, flustered by King’s peaceful approach to obtaining African-American rights, wrote, â€Å"The Ballot or the Bullet,† as a direct response to King’s famous â€Å"I Have a Dream† speech spoken only a month before. Like King, Malcolm appeals to the emotions of his young black audience, stirring them with anger; and simultaneously, striking fear into the minds of his white listeners. Malcolm’s goal for this speech was to persuade his audience to take action into their own hands and bring about a serious long lasting change. â€Å"The Ballot or the Bullet† begins with Malcolm’s attempt to connect with his audience. He begins by greeting both his friends and enemies speaking out, â€Å"I just can’t believe everyone in here is a friend and I don’t want to leave anybody out† (X, Malcolm. Speech). X, immediately grab s the attention of his audience by, identifying with them, also putting aside religious aspects and focusing on simply â€Å"working together and putting aside their differences to fight for their rights† (Critical). As Malcolm continues delivering his speech, his use of repetition keeps his audience aroused with anger. X repeats, â€Å"I am not†¦Ã¢â‚¬  allowing his audience to identify with him, especially when he says that he is â€Å"not an American, but a victim of Americanism† (X, Malcolm. Speech). Here, Malcolm has fallen victim to racism. When X refers to â€Å"Americanism† he refers to things the United States is guilty of, like sexism, racism, and the power that the government has over people. In this quote, he doesnt feel like a citizen of America anymore, although he should. He is equal to everyone else, but is treated otherwise just because he is African-American. The strong and powerful words that these two men spoke out will always be remembered in the history of the civil rights movement. Although King is a heroine in the eyes of the movement, his methods of obtaining a change were very amicable. It was Malcolm X’s strong militant diction, and his power to stir the crowds’ emotions that helped him instill more passion in what he was arguing for. X’s approach may have arisen from his catastrophic childhood, instilling him to speak out on black supremacy, and the liberation from having the government having control over them. Speech: Accepting and Dealing with Change :: essays research papers

Change can have many meanings. It is going from â€Å"same† to â€Å"different†. Change can be defined as an event that occurs when something passes from one state or phase to another and as a process of transition. The forces of change affect attitudes, beliefs and behavior. Not a single moment goes by when everything in our lives will remain the same. When you become adjusted to your surroundings, something changes again. Changes can affect both individuals and groups. Throughout our lives we go through many changes, especially in adolescence. This is shown in the song Graduation by Vitamin C. Graduation is about the change of leaving high school and moving on to adulthood. It shows the many questions young people have about leaving school, and uncertainty of the future. At the same time, it shows the constant of friendship that people can rely on, when many other things in their life are changing. Some people who have dealt with changes in their lives have become inspirational to others because of their courage, determination and optimism. Examples of such people are the Biggest Loser contestants and also Bethany Hamilton. The television program the Biggest Loser shows people changing their lives physically and emotionally through diet and exercise. People watching the show could relate to these people, which could give them inspiration and motivation to make changes of their own. Bethany Hamilton is an example of dealing with change in an optimistic way. In October 2003, Bethany was attacked by a shark while out surfing in Tunnels beach, Hawaii. Without warning, a Tiger shark attacked her surfboard, dragging her back and forth and then disappearing into the ocean. Bethany was able to compose herself to use her right arm to swim back to the shore. She was later taken to hospital with severe injuries, where her left arm was amputated. She came through her recovery with things that were important to her, such as her family and her Christian faith. Despite the trauma of the incident, Hamilton was determined to return to surfing. Just 10 weeks after the accident, she returned to the ocean and went surfing again. She adjusted to the change by using a custom made surfboard and changing her surfing style. Bethany taught herself to surf with only one arm and she also began surfing competitively in competitions again. Hamilton claims that the loss of her arm was a bles sing in disguise.

Porter’s five forces model shows that there is already a low barrier to enter but it is hard to establish a distinct brand name, threat of substitutes is strong for the retail apparel industry, the intensity of rivalry is high since the industry is already facing a fast growth, supplier’s bargaining power is weak because they have limited power, and lastly buyers’ power is strong as they have variety of choices. Threat of New Entrant Although it is not hard to enter the clothing retail business, it is hard to establish a distinct brand name. Gap faces little threat of increases in price competition by entry of new firms into the market. Smaller boutique-style clothing stores may be able to compete on a local level brand, however such firms likely would not be able to expand, and Gap enjoy a cost advantage in producing staple articles of clothing, such as jeans and sweaters. Due to economies of scale in producing large amounts of clothing, entrants will have extremely hard time producing clothing at cheap enough prices to compete with Gap and its competitors. Entrants would also have difficulty in finding supplier firms who would produce their clothing at a competitive cost level. Costs drop per unit of clothing produced, and an entering firm would need to order a large amount of clothing in order to enjoy the same economies of scale that Gap enjoys. Brand loyalty is also important in fashion. Because many consumers have strong preferences for certain brands or styles of clothing, new entrants would find difficulty in increasing the amount of customers they attract to their stores without incurring significant advertising expenses. Because of their size advantage and economies of scale in advertising, Gap has a significant advertising advantage over all other direct competitors within the specialty apparel market. They can afford to run well-known nationwide television advertising campaigns while other firms in the market do little or no TV advertising. A new entrant trying to steal away brand loyal customers from Gap would need vast advertising resources in order to establish their brand and be competitive, which is unlikely for an emerging firm. Threat of Substitutes There are many substitutes in casual clothing industry. Since there are a wide variety of products that people can choose, they could either be substituted by sporting products, business apparels, cheap clothing materials, and others. On an industry level, there is no popular substitute for clothing. A booming economy where individuals have more disposable income may lead them to buy more clothing. In the reverse situation, demand for new clothing will likely drop if the economy is performing poorly. Because there are no substitutes for clothing, an increase in price by one firm will cause consumers to purchase clothing from another firm. If prices rise throughout the industry, consumers will buy less clothing. Bargaining Power of Suppliers In retailing industry, the power of suppliers varies depending on the company itself. As per Gap, Inc. , the suppliers have limited power. The annual report states that no suppliers supply more than 3% of the company’s demand. This gives Gap, Inc. power to set the price of its raw materials. Supplier power is concentrated in the firms who supply the raw materials for clothing production and the factories that are contracted to produce them. There are many sellers in both markets, and the power they possess is limited since demanding a higher price will cause the clothing manufacturer to buy the raw materials elsewhere. For instance, Gap contracts factories in over 60 different countries; if one factory is asking too high a price to produce their clothes, Gap can take their business elsewhere. Only if a factory holds a certain expertise in producing a certain type of clothing will they hold much power over the firm selling the clothes. Bargaining Power of Buyer The buyers have variety of choices to make in the retail clothing industry. Since there are various competitors and substitutes in the company, the buyers might move shopping around. Hence, the companies have to work harder to retain the clients. Intensity of rivalry between existing competitors Gap Inc. operates within the specialty retail apparel market, a market which contains several large direct competitors, such as American Eagle Outfitters, Abercrombie and Fitch, J. Crew and Aeropostale. Because of the nature of the fashion industry, independent specialty stores and boutiques can compete with these larger brands on a localized level. It is worth mentioning that superstore retailers such as Target and Wal-Mart sell low-priced, lower-quality clothes, so they could also be considered as indirect competitors to Gap. Clearly, there are a large number of apparel retailers, and a smaller, though still large, number of direct competitors to Gap within the specialty retail industry. This competitive landscape lends itself to a high level of price competition. The company is bound to encounter tough rivalry not only from established local brands but from other American casual-clothing labels, including Esprit, Levi Strauss, Tommy Hilfiger and Ralph Lauren. Competition, therefore, arises in fashion. Firms want to appeal to as many consumers as possible while keeping those already loyal to the brand happy with the style of clothes the firm offers. The winning style maintains the brand loyal customers association with the firm’s image, while attracting new buyers. A mistake in fashion, however, will lead some loyal customers to abandon their brand, and will fail to attract new customers. Employment and Natalie Essay

Natalie Attired worked at Biddy’s for one year when she was fired for getting a sleeve tattoo on her upper right arm. Natalie was fired because Ms. Biddy claimed that she her appearance was disturbing the clients while they were trying to eat. There is no employee manual or written policy about employee conduct. Natalie while for unemployment in July 2010 but was denied because she was terminated for â€Å"misconduct.† Biddy’s has been in for over 20 years and is run by Biddy Baker, age 60. Biddy evaluates her waitress’ performance every three months. Questions Presented: Was Natalie’s tattoo in fact a distraction to the customers in the restaurant? Were there any guidelines in place that would in fact tell Natalie that she was in violation of the dress code? Did Ms. Biddy talk to her employee about how she wants there to present themselves while at work? Brief Answers: Two customers complained that Natalie’s tattoo was distracting. There were not any guidelines or employee handbook that stated was acceptable or not acceptable. Ms. Biddy did evaluate her employees every 3 months but in the evaluations she did not state how she wanted her employees to present themselves. Rules that Apply: According to the New Mexico Statutes Annotated,  § 51-1-7  § 51-1-7. Disqualification for benefits A. An individual shall be disqualified for and shall not be eligible to receive benefits: (1) if it is determined by the division that the individual left employment voluntarily without good cause in connection with the employment. Analysis: According to the definition of misconduct as stated above Ms. Attried did not in fact get fired for misconduct she did in fact get fired because Ms. Biddy felt her tattoo was a hinder to her business. In Natalie’s evaluations she was evaluated as a good employee who just needed to learn a few things to get her job skills up to par. Nowhere is it stated that she did anything to make her employer have to take negative action against her. She was always on time for work, she was pleasant with the customers, and she usually gets all the orders. Conclusion: Natalie was wrongly denied her unemployment benefits because she does not fit the criteria to be denied because of misconduct. She did perform her job to the best or her knowledge and there was no handbook to ensure that she was wrong about getting the tattoo. If Ms. Biddy wants her employees to conduct themselves a certain way she should provide guideline to ensure that they in fact know what is expected of them. Natalie should be able to receive her benefits and should have them backtracked to her original file date of unemployment.

Definition and Examples of Red Herrings in Logic In logic and rhetoric, a red herring is an observation that draws attention away from the central issue in an argument or discussion; an informal logical fallacy. Also called a decoy. In certain types of fiction (especially in mystery and detective stories), authors deliberately use red herrings as a plot device to mislead readers (metaphorically, to throw them off the scent) in order to maintain interest and generate suspense.The term red herring (an idiom) supposedly arose from the practice of distracting hunting dogs by dragging a smelly, salt-cured herring across the trail of the animal they were pursuing. The methods were made to be interactive so as to get the information directly from the students. This was done so as to obtain accurate and efficient data from the study. This would be realized by analyzing the findings collected from the study and coming up with concrete solutions that would enable the students to learn effectively. Findings After taking a sample of forty students from various faculties in the institution by random sampling method, it was established that 40% of the students take 5 – 6 hours in their personal studies while 60% take under 5 hours on their personal studies. The majority of the students was found to allocate a few hours to their personal st udies due to the fact that during the daytime, they have to attend lectures that are in most cases spread across the day with break intervals to prepare for coming lectures or go for lunch. In the wee hours of the day, most students were established to concentrate more on their social welfare than creating more time for their personal studies. 40% of the sampled students who were found to spend more time in their personal studies were serious in pursuing successfully their faculties.
